Uncontested Divorce Options in NY
One common approach to divorce is to negotiate a settlement without having to appear in court – this is known as a separation agreement. If both parties are willing to participate in open and honest negotiations, this can be a highly effective approach to resolving matrimonial issues with minimal legal fees. Parties who have jointly signed a separation agreement can easily submit an uncontested divorce to become legally divorced if they so choose.
An alternative option is to commence a contested divorce proceeding in which both parties would be required to appear in court for one or more court conferences. Over the course of the proceeding, parties are required to exchange financial documents, conduct depositions, and ultimately appear at trial. However, very few of these cases reach trial, and a majority are resolved by written settlement, known as a Stipulation of Settlement.
During your uncontested divorce, you will have to address:
- Custody of children
- Parental Access Schedules
- Child support
- Spousal support/maintenance
- Equitable distribution of marital assets, including but not limited to real property (marital residence), retirement accounts, bank accounts, and vehicles
- Allocation of marital debts, including credit card debt
Our Long Island uncontested divorce attorneys can help you navigate this process and make informed decisions that reflect your best interests.

Pickney Law Firm’s retainer fee for representation in a simple divorce starts at $2,500.00. If both parties cooperate and actively participate in the divorce process, a settlement can be achieved in a matter of weeks. Refusal by one or both parties to produce necessary financial statements and negotiate in good faith will affect the cost of legal fees and the time it takes to complete the divorce.
